In accordance with the provisions of Articles 6-III and 19 of French Act No. 2004-575 of 21 June 2004 on Confidence in the Digital Economy, known as the L.C.E.N., we hereby bring the following information to the attention of users and visitors of the WebStrator.com website:

Conditions for subscribing to the web hosting and CloudPods™ services

Any user wishing to subscribe to one of the services offered on the WebStrator.com website, web hosting or CloudPod™, must complete a form made available on the site, answering the requests for information presented to them accurately and truthfully.
They certify that they have first ensured that they meet all the conditions required to access and operate the environment for which they are subscribing to a service, in particular the age and licence conditions.
If, for any reason whatsoever, they no longer meet the required conditions, the User must immediately stop using the corresponding service or services.

User: any internet user connecting to, any customer using our services, or the website named: WebStrator.com

General terms of use of the website and of the services offered

Use of the WebStrator.com website implies full and unreserved acceptance of the general terms of use described below.
These terms of use may be modified or supplemented at any time without notice; users of the WebStrator.com website are therefore invited to consult them regularly.
WebStrator is in principle accessible to users 24 hours a day, 7 days a week, except in the event of an interruption, whether scheduled or not, for maintenance purposes or in cases of force majeure. Should access to the service become impossible, WebStrator undertakes to do its utmost to restore access to the service and will then endeavour to notify users in advance of the dates and times of the work.
Being bound only by an obligation of means, WebStrator may not be held liable for any damage of any nature whatsoever resulting from unavailability of the service.
The WebStrator.com website is updated regularly by the site owner. Likewise, the legal notices may be modified at any time, without notice, and are binding on the user without reservation.
The user is deemed to accept them without reservation and to refer to them regularly in order to be aware of any changes.
The WebStrator.com website also reserves the right to assign or transfer, without notice, the rights and/or obligations under these terms of use and sale and legal notices.
By continuing to use the Services of the WebStrator.com website, the user acknowledges acceptance of any changes made to the general terms.
WebStrator.com prohibits the use of any additional system or any external backup system other than the one included in the service.
WebStrator.com tolerates the use of external scripts that download/back up the data provided, using the file access. (FTP/FTPS)
Please note that should the user make abusive and repeated use of the resources of the server allocated to them, WebStrator reserves the right to suspend the service.

Description of the services provided:

WebStrator provides two independent services, which may be subscribed to separately or together:
web hosting, comprising, depending on the chosen configuration, one or more web servers, MariaDB databases, mailboxes, FTP/FTPS access, an SSL certificate and scheduled tasks;
CloudPods™, dedicated and isolated environments intended to run a specific language or tool, with their own credentials and their own console.
The resources of each service are chosen by the User when ordering and may be added or removed at any time from their client area, with billing adjusted pro rata for the remaining period.
The purpose of the WebStrator.com website is also to provide information about all of the company's activities.
The site owner endeavours to provide information on the WebStrator.com website that is as accurate as possible.
However, it may not be held liable for omissions, inaccuracies or shortcomings in updating, whether caused by itself or by the third-party partners who supply it with this information.
All the information provided on the WebStrator.com website is given for guidance only, is non-exhaustive and is subject to change.
It is provided subject to any modifications made since it was published online.

Limitations of liability

The WebStrator.com website may not be held liable for typographical errors or inaccuracies appearing on the service, or for any damage suffered as a result of its use.
The user remains responsible for their equipment and its use, and likewise bears alone the direct or indirect costs arising from their connection to the Internet.
Users of the WebStrator.com website undertake to access it using recent, virus-free equipment and an up-to-date, latest-generation browser.
The user releases WebStrator from liability for any harm they may suffer or cause, directly or indirectly, as a result of the services offered.
Only the user's liability is engaged by the use of the service offered, and the user expressly releases the WebStrator.com website from all liability towards third parties.
Interactive areas (the possibility of asking questions in the contact area) are available to users.
The WebStrator.com website reserves the right to delete, without prior formal notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection.
Where applicable, the site owner also reserves the right to hold the user civilly and/or criminally liable, in particular in the event of a racist, insulting, defamatory or pornographic message, whatever the medium used (text, photograph, etc.).

Intellectual property

All software, information presentations, applications, names, trade names, texts, comments, images, illustrations, product or service trademarks, inventions and, more generally, any creation of any nature whatsoever that is accessible by means of the WebStrator.com website remain the exclusive property of their respective owners.
The compilation and transmission of data, information and software are carried out under the control and responsibility of the user.
The User is authorised to use all the programs, services and features made available to them within the WebStrator.com online service, in compliance with the intellectual property rights of WebStrator, of program suppliers, of software publishers or of any other rights holder.
In particular, the User is personally responsible for holding the rights to use the content, software, content management systems, extensions and themes that they host or install on their services, and may not hold WebStrator liable on any grounds whatsoever if they themselves or the users to whom they have granted access did not hold the rights required.
The User retains full ownership of the content, files and databases they host on their services. WebStrator acquires no rights over them and holds only the technical access strictly necessary for hosting, backing up and maintaining the services.

Hyperlinks and cookies

The WebStrator.com website contains a number of hyperlinks to other websites (partners, information, etc.).
However, the site owner is not able to verify the content of the sites thus visited and therefore declines all liability in this respect as regards any risk of unlawful content.
The user is informed that, during their visits to the WebStrator.com website, one or more cookies may be installed automatically on their computer.
A cookie is a small file which does not allow the user to be identified, but which records information relating to a computer's browsing on a site.
The data thus obtained is intended to facilitate subsequent browsing on the site, and is also intended to enable various traffic measurements.

Applicable law and attribution of jurisdiction

Any dispute relating to the use of the WebStrator.com website is subject to French law.
The user and WebStrator agree to submit to the exclusive jurisdiction of the French courts in the event of a dispute.

Term / Renewal / Termination

The contract is initially concluded for the contractual term chosen at the time of ordering (1, 3, 6, 12 or 24 months).
The User has an automatic renewal feature enabling them to extend their service for the same duration by way of a new debit of the same amount at the end of the current period. This feature may be cancelled at any time from the client area.
The details of the payment method to be debited may be changed by the User at any time.
The contract is governed by these general terms of use.
The subscription starts to run from the time the service is made available by WebStrator to the customer.
These general terms apply throughout the contract, including in the event of an extension and on the occasion of any use of the services of WebStrator.
The termination process is automatic and takes place at the end of the last period paid for: the User simply has to not renew their service.
After expiry, the service is automatically closed to the customer and their data becomes inaccessible to them. It is therefore the responsibility of the User to retrieve their files, databases and emails before the expiry date.
From then on, the User's data may be deleted by WebStrator at any time.
Should the User fail to meet their obligations or fail to comply with these general terms of sale, WebStrator reserves the right to terminate or suspend the contract without notice or compensation.

Payment terms

Payment for the services provided by WebStrator is made at the time of ordering, before the start of the subscribed period.
The accepted payment methods are credit card (with 3D Secure authentication), PayPal, Paysafecard, Dedipass and WebStrator credits.
Payment by credit card or PayPal enables the automatic renewal feature: the debit corresponding to the new period is made before the end of the period currently in force, for the same duration and the same amount, from the payment method saved by the User, unless changed by the latter. This feature may be cancelled at any time from the client area.
The invoicing system is automatic and the services are subject to VAT.
The User has 24 hours from payment to request a refund of their order, by opening a support ticket from their client area and stating the reason for the request. The refund is then returned in full to the original payment method. Where the payment method used does not allow a direct refund, the corresponding amount is credited back to the customer's account as WebStrator credits.
After this period, and given the digital nature of the services provided, no refund may be claimed.

Protection of property and persons - management of personal data

Personal data is protected in particular by Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR), by French Act No. 78-17 of 6 January 1978 as amended on information technology, data files and civil liberties, and by Article L. 226-13 of the French Criminal Code.
On the WebStrator.com website, the site owner collects personal information relating to the user only as required for certain services offered by the WebStrator.com website.
The user provides this information in full knowledge of the facts, in particular when they enter it themselves.
Users of the WebStrator.com website are then informed whether or not they are required to provide this information.
In accordance with the GDPR and French Act No. 78-17 of 6 January 1978 as amended, all users have a right to access, rectify, erase, restrict, port and object to personal data concerning them.

No personal information of users of the WebStrator.com website is published without their knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties.
Only in the event of the purchase of the WebStrator.com website from the site owner, together with its rights, would such information be transmitted to the potential acquirer, who would in turn be bound by the same obligation to retain and modify the data with respect to users of the WebStrator.com website.
Databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
